Terms and Conditions – Samisha Holidays LLP

These Terms and Conditions (“Agreement”) govern your use of services provided by Samisha Holidays LLP (“Samisha”, “we”, “our”, “us”) and constitute a legally binding agreement under the applicable laws of India. By booking with us, you agree to these terms.

1. General Terms

All bookings made with Samisha Holidays LLP are subject to availability and acceptance. Samisha reserves the right to decline any booking at its discretion. The customer must provide accurate personal details, including PAN for TCS compliance as per Section 206C(1G) of the Income Tax Act.

2. Tour Inclusions and Exclusions

Our tour packages include only those services explicitly listed under ‘Inclusions’. Any additional costs such as meals, personal expenses, travel insurance, visa fees, and tips are to be borne by the traveler unless otherwise stated.

3. Payment Terms

A minimum of 30% advance is required to confirm any booking. Full payment must be received at least 14 days before the departure date. Payments must be made via bank transfer, UPI, or authorized payment gateways.

4. GST and TCS

All invoices are subject to 5% GST as per Notification No. 11/2017 under SAC 9985 (Tour Operator Services). Additionally, for overseas tour packages, 5% TCS under Section 206C(1G) is collected and deposited with the Income Tax Department. If PAN is not provided by the customer, TCS shall be charged at 20% as per applicable law.

5. Cancellation Policy

Cancellation charges apply as follows:
– More than 30 days before departure: 10% of total package
– 15 to 30 days: 25%
– 7 to 14 days: 50%
– Less than 7 days or no-show: 100%
All cancellation requests must be made in writing.

6. Refund Policy

Refunds, if applicable, will be processed within 10–15 business days. Taxes, TCS, and non-refundable charges (like airline cancellation fees) are not eligible for refund.

7. Customer Responsibilities

It is the customer’s responsibility to ensure they have valid travel documents, including passport, visa, and insurance. Samisha Holidays LLP is not responsible for denied boarding, immigration issues, or delayed documentation.

8. Liability Disclaimer

Samisha Holidays LLP acts as an agent for various independent suppliers and shall not be held responsible for any loss, injury, accident, delay, or damage from any act of God, force majeure, or third-party service failure.

9. Jurisdiction and Governing Law

All disputes shall be subject to the exclusive jurisdiction of the courts in Pune, Maharashtra. This agreement shall be governed by the laws of India, including the Consumer Protection Act, 2019 and the Information Technology Act, 2000.

10. Modification of Terms

Samisha Holidays LLP reserves the right to modify these terms at any time without prior notice. The revised terms will be published on our website and will become effective upon posting.
